Please read these terms carefully before using our services or submitting a hiring request.
These Terms of Service ("Terms") govern your use of the Flywheel Staffing website at hireflywheel.com ("Site") and the staffing and talent sourcing services ("Services") provided by Flywheel Staffing ("Flywheel," "we," "us," or "our"). By accessing the Site or engaging our Services, you agree to these Terms.
1. Services Description
Flywheel Staffing is a remote staffing agency that sources, screens, and presents qualified global talent to businesses ("Clients") seeking to fill professional roles. Our Services include:
- Consultation to define role requirements and candidate profiles
- Global talent sourcing and multi-stage candidate screening
- Presentation of a curated shortlist of vetted candidates
- Support with offer documentation and candidate onboarding coordination
Flywheel acts as a staffing intermediary. We are not an employer of record, a payroll provider, or a legal compliance service. Responsibility for final hiring decisions, employment agreements, payroll, and ongoing HR management rests with the Client.
2. Our Right-Fit Commitment
What "right-fit commitment" means: If you are not satisfied with the candidates presented in your initial shortlist, Flywheel will make commercially reasonable efforts to source and present additional candidates at no additional placement fee, subject to the conditions below.
2.1 What It Covers
The right-fit commitment applies when:
- You have reviewed the candidates in your shortlist and provided written feedback explaining why they do not meet the agreed-upon role requirements
- The feedback relates to qualifications, skills, or fit criteria established at the start of the engagement — not preferences that were not disclosed during the intake process
- You have not yet extended an offer to any presented candidate
2.2 What It Does Not Cover
The right-fit commitment is a good-faith service commitment — not a legal guarantee. It does not apply to, and Flywheel is not obligated to re-source under, the following circumstances:
- The role requirements were substantially changed after sourcing began
- A hiring decision was made but did not work out after the hire commenced employment
- The Client has not responded to candidate profiles within 14 days of delivery
- The Client has not paid applicable fees in accordance with any executed service agreement
- The feedback provided is subjective or unrelated to the agreed candidate criteria
2.3 No Guarantee of Outcome
Flywheel does not guarantee that sourcing efforts will result in a successful hire. Talent availability varies by role, region, and market conditions. We commit to making reasonable, diligent efforts on your behalf — but we cannot guarantee outcomes, timelines, or the long-term performance of any hired individual.
3. Placement Fees and Payment
Placement fees are charged on a per-hire basis and are due upon the commencement of employment of the placed candidate. Specific fee amounts and structures are outlined in your individual service agreement or as communicated in writing by Flywheel prior to engagement.
No placement fee is charged unless and until you make a hire from a Flywheel-presented candidate. Fees for re-sourcing under the right-fit commitment are waived as described in Section 2, unless a new, separate engagement is initiated.
4. Accuracy of Information
Content on this Site — including salary comparisons, cost estimates, and savings projections — is provided for illustrative purposes only. These figures are based on publicly available data and general market estimates. They do not represent guaranteed costs, savings, or outcomes for any specific engagement.
Flywheel makes no representation that the information on this Site is accurate, complete, or current. We recommend that you independently verify any figures that are material to your business decisions.
5. Client Responsibilities
By engaging Flywheel's Services, you agree to:
- Provide accurate, complete information about your role requirements and hiring criteria
- Respond to candidate profiles and communications in a timely manner
- Treat all candidate information shared by Flywheel as confidential
- Comply with all applicable employment, anti-discrimination, and labor laws in your jurisdiction when evaluating and hiring candidates
- Not directly solicit or engage any Flywheel-sourced candidate outside of a completed placement without our prior written consent within 12 months of introduction
6. Confidentiality
Candidate profiles, resumes, assessments, and related materials shared by Flywheel are confidential and may only be used for the purpose of evaluating candidates for your open role. You agree not to share this information with third parties without Flywheel's prior written consent.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Flywheel Staffing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services or Site, including but not limited to:
- Loss of revenue, profits, or business opportunities
- Performance or conduct of any placed candidate after hire
- Delays in the sourcing or placement process
- Reliance on salary estimates or cost projections published on this Site
Our total liability to you for any claim arising from these Terms or our Services shall not exceed the placement fees paid to Flywheel in the three months preceding the claim.
8. Intellectual Property
All content on this Site — including text, graphics, logos, and design — is the property of Flywheel Staffing and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.
9. Third-Party Links
Our Site may contain links to third-party websites. These links are provided for convenience only. Flywheel does not endorse, control, or take responsibility for the content or practices of any third-party site.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our Site or Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in California.
